Terms of Service

These Terms of Service ("Terms") govern your use of ScratchPicks, operated by ScratchPicks LLC ("ScratchPicks", "we", "us", "our"). By subscribing to or using the ScratchPicks newsletter, website, or any related service (together, the "Service"), you agree to these Terms.

Important: ScratchPicks is an entertainment newsletter. We rank publicly available state lottery scratch ticket data so you can make more informed buying decisions. We are not affiliated with any state lottery, we do not sell lottery tickets, and we do not guarantee any outcome. Lotteries are games of chance and any individual ticket is a losing ticket in expectation.

1. Eligibility

You must be at least 18 years old (or 21 in states where 21 is the minimum legal age to purchase a lottery ticket) and legally able to purchase lottery tickets in your state to use the Service. By using the Service, you represent that you meet these requirements. We reserve the right to terminate the accounts of users we believe to be underage.

2. Entertainment purposes only — no guarantees

THE SERVICE IS PROVIDED FOR ENTERTAINMENT AND INFORMATIONAL PURPOSES ONLY.

ScratchPicks ranks scratch tickets based on remaining-prize data we scrape from public state lottery websites and APIs. We do not:

Guarantee that any ticket will win any prize.
Guarantee that our data is current, accurate, or complete.
Provide financial, investment, or legal advice.
Sell, distribute, or redeem lottery tickets.
Have any relationship with state lottery commissions.

Lotteries are games of pure chance. A ticket with "better remaining odds" is still overwhelmingly likely to lose. Never spend money on lottery tickets that you cannot afford to lose.

3. Accuracy of information

We make reasonable efforts to collect and present lottery data accurately, but the data is pulled from third-party sources that may be outdated, incomplete, or incorrect. We make no warranty that the rankings, expected values, or remaining prize counts shown in our emails reflect real-world current conditions. Always verify information with your state lottery's official resources before making a purchase decision.

4. Subscriptions, billing, and cancellation

Free tier — weekly picks. No charge.
Paid tier — daily picks, billed $9.99 per month via Stripe.
Subscriptions renew automatically each month until cancelled.
You can cancel any time through the unsubscribe link in any email (which routes paid subscribers to Stripe's secure customer portal) or by emailing hello@tryscratchpicks.com.
Cancellations take effect at the end of the current billing period. We do not issue prorated refunds for unused time unless required by law.
Prices may change with at least 30 days' notice to active subscribers.

5. Acceptable use

You agree not to:

Resell, redistribute, or publicly reproduce the contents of our emails without written permission.
Scrape or automate access to the Service.
Create accounts on behalf of other people without their permission.
Use the Service to violate any law, including laws in your jurisdiction regulating gambling or age-restricted content.

6. Intellectual property

The ScratchPicks name, brand, scoring methodology, email templates, and website content are the property of ScratchPicks LLC. Scratch ticket names, imagery, and prize data are the property of their respective state lotteries and are used here under fair use for commentary and reporting.

7. Termination

We may suspend or terminate your subscription if you violate these Terms, abuse the Service, or engage in fraudulent activity. You may terminate at any time by unsubscribing.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCRATCHPICKS LLC, ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING LOST MONEY FROM LOSING LOTTERY TICKETS. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold ScratchPicks LLC harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law.

11. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction and venue of those courts.

12. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will notify active subscribers by email at least 7 days before the effective date. Continued use after the effective date constitutes acceptance.
